Islam made divorce possible to protect people from harm. Here is everything you need to know about talaq, khula, legal rights, and moving forward.

The Prophet ﷺ said: "Of all the permitted things, the most hated by Allah is divorce." — Abu Dawud 2178. This hadith places divorce in a specific category: something Allah has allowed (because sometimes it is necessary) but which He dislikes. The ideal is reconciliation. When reconciliation is impossible, divorce is better than ongoing harm.

Divorce Options in Pakistan

Talaq (Husband Initiates)

The husband pronounces talaq. Under Muslim Family Laws Ordinance 1961, he must notify the Union Council Chairman within 90 days. The Union Council establishes an arbitration council for reconciliation. If reconciliation fails, talaq becomes effective after 90 days.

Khula (Wife Initiates)

A woman's right to seek dissolution of marriage through the courts. She may return her mahr (or a portion) to her husband. This is her Islamic and legal right. No man can prevent a wife from seeking khula through the Family Court.

Judicial Separation

Available through Family Court for specific grounds including cruelty, non-maintenance, imprisonment, or abandonment.

Women's Rights in Divorce in Pakistan

The Iddah Period

After talaq, a woman must observe iddah — typically three menstrual cycles (about three months). During this time she may not remarry. She receives maintenance from her husband. The iddah protects against confusion about paternity and allows time for reconciliation.

Reconciliation — Always Worth Trying First

Islam strongly encourages reconciliation. The Quran (An-Nisa 4:35) recommends appointing an arbitrator from each family if there is marital strife. If both parties genuinely desire reconciliation, Allah may bring them back together. Never make a permanent decision during temporary emotion.
